1. General

1.1 Before proceeding with a purchase, you should read these Terms and Conditions carefully. You must not complete your purchase unless you agree with these Terms and Conditions. By purchasing a ticket to an event held by TEDxMelbourne, you confirm that you agree to these Terms and Conditions.

1.2 Nothing in these Terms & Conditions excludes or restricts any rights or remedies a Consumer may have under the Australian Consumer Law.

2. Purchase of Tickets

2.1 Tickets are only valid if purchased through TEDxMelbourne or an authorised agent.

2.2 TEDxMelbourne sells tickets through Eventbrite. By purchasing your ticket through Eventbrite’s website, you not only agree to these Terms and Conditions, but you also agree to Eventbrite’s terms and conditions, which can be found here: Eventbrite Legal Terms.

2.3 Tickets may not, without the prior written consent of TEDxMelbourne, be resold or offered for resale at a premium (including via on-line auction sites), nor may they be used as a prize or for advertising, promotional, or other commercial purposes. Tickets
sold or used in breach of this condition may be cancelled without a refund, and the bearer of the relevant ticket may be refused admission.

2.4 TEDxMelbourne may place limits on the number of tickets that you can purchase. TEDxMelbourne reserves the right to cancel and not refund any purchase exceeding those limits.

3. Pricing and Payment

3.1 All prices are quoted in Australian dollars and are inclusive of GST. Where GST applies, your ticket is a tax invoice.

3.2 Tickets advertised at a particular price will be available for purchase for a reasonable period of time (or in a reasonable quantity).

3.3 Prices are subject to change without notice.

3.4 A service charge or fee may apply to each purchase and you will be notified of the applicable fee prior to purchase.

3.5 TEDxMelbourne reserves the right to retain any fees charged, to the extent permitted by law.

3.6 You warrant that you have the authority to make payment for your purchase and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to make the purchase.

3.7 TEDxMelbourne will only process an order once billing information has been verified. The supply of incorrect or incomplete billing information may delay processing and delivery of orders. In this case, TEDxMelbourne will endeavour to contact you using the information you provided at the time of purchase. If TEDxMelbourne is unable to reach you after an initial attempt, TEDxMelbourne may cancel your order.

3.8 If the amount paid for a ticket is incorrect regardless of whether an error in price is posted on the website or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date, or you are able to order a ticket that was not supposed to have been released for sale, then TEDxMelbourne reserves the right to cancel that ticket (or the order containing the ticket) and refund the total amount paid. This policy will apply regardless of whether the transaction was a human error or website/system malfunction. In this case, TEDxMelbourne may offer you a replacement ticket (if available) at the correct price.

4. Delivery and Collection of Tickets

4.1 Methods of collection and/or delivery will be available when choosing your collection/delivery details during online checkout.

4.2 Adequate time must be allowed for the presentation of tickets on arrival at the venue. TEDxMelbourne does not accept responsibility for any delays that may be encountered should you arrive without adequate time to present your ticket at an event.

5. Program

5.1 TEDxMelbourne reserves the right to change advertised programs and their respective content, dates and times, prices, venues, seating arrangements and audience capacities without notice.

5.2 Speakers at TEDxMelbourne events may be changed or cancelled without notice, even if such Speakers have been advertised prior to purchase.

5.3 Any changes to the program or Speakers will not result in the availability of a cancellation or refund or claim against TEDxMelbourne.

5.4 TEDxMelbourne makes no warranties or other confirmatory statements about the content of its program, Speakers or events.

6. Exchanges and Refunds

6.1 Ticket’s cannot be refunded or exchanged after purchase except as required by law or as otherwise specified by TEDxMelbourne.

6.2 Ticket exchanges may be permitted under certain conditions and as required by law (including the Australian Consumer Law), in which case fees may apply.

6.3 You will only be entitled to a refund where the event is cancelled by TEDxMelbourne. In this case, refunds will be paid to the original ticket purchaser, proof of identity and proof of purchase may be required and refunds will be applied to the original payment method or as otherwise suitable.

6.4 If a cancellation occurs, refunds will be limited to the face value of the ticket plus GST. You will not be reimbursed for any third party ticketing fees charged by Eventbrite or any auxiliary expenses in connection with your attendance at a cancelled event. You may wish to take out ticket and/or travel insurance for such expenses.

7. Lost or Stolen Tickets

7.1 Where tickets are lost, stolen, misplaced or damaged, TEDxMelbourne reserves the right to charge a replacement fee and may require proof of identification of the ticket purchaser prior to doing so.

7.2 In cases when seating is not allocated (general admission), TEDxMelbourne reserves the right to refuse ticket replacement.

8. Conditions of Entry

8.1 The right of admission is reserved by TEDxMelbourne.

8.2 Ticket holders may be required to produce their ticket(s) as proof of authorised entry at any time.

8.3 By attending an event, you agree to the relevant venue’s conditions of entry.

8.4 You may be refused entry or required to leave the venue for any valid reason, as determined by TEDxMelbourne acting in its sole discretion including, without limitation, for any breach of these Terms and Conditions or the venue terms and conditions.

8.5 Late comers will only be admitted to an event at the discretion of the venue and/or TEDxMelbourne and may be refused entry completely.

8.6 Ticket holders enter the venue at their own risk.

8.7 You understand that attendance at any event may carry with it certain dangers, including the risk of injury and damage to you or your property.

8.8 By attending a TEDxMelbourne event, you accept the risk of damage and loss (including property damage, personal injury, economic and consequential loss) howsoever arising (including by negligence). This includes damage or loss caused by the acts or omissions of other ticket holders, visitors, guests, employees and agents of the venue, volunteers or representatives of TEDxMelbourne or a Speaker or presenter.

8.9 TEDxMelbourne reserves the right to search a person and/or their possessions prior to entering the venue if required. Refusal to comply may result in non-admittance.

8.10 TEDxMelbourne reserves the right to request that any individual article larger than an A4 sheet of paper be cloaked prior to entering the venue.

9. Photography, Filming and Broadcasting

9.1 TEDxMelbourne reserves the right to record, broadcast or telecast any event.

9.2 If you are photographed, filmed or taped whilst attending a performance at TEDxMelbourne, you consent to TEDxMelbourne or third parties appointed or approved by TEDxMelbourne photographing, filming and taping you.

9.3 TEDxMelbourne or third parties appointed by TEDxMelbourne can broadcast, publish, license and use any photographs, film, recordings and images of you without compensation. TEDxMelbourne, the third parties and anyone acquiring from them a right to use the material are not liable to you in any way for its use.

9.4 You are not allowed to photograph, film or otherwise record the event. TEDxMelbourne prohibits the use of audio and visual recording equipment in all of its venues, unless expressly authorised by TEDxMelbourne.

10. Limitation of Liability

10.1 To the extent permitted by law (including the Australian Consumer Law), TEDxMelbourne is not liable to you for any loss, damage, injury, delays, additional expenses or inconvenience arising as a result of your attendance or non-attendance at an event.

10.2 Where liability cannot be excluded or modified by law, including pursuant to the Australian Consumer Law, the liability of TEDxMelbourne is limited to the minimum permitted by law.

11. Privacy

11.1 TEDxMelbourne respects the privacy of its patrons and strictly dheres to the principles of the Privacy Act 1988.

11.2 You may be asked to provide personal information (including your email address, postal address and other contact information) when making a purchase. Please ensure that you provide current, complete and accurate information. If you do not provide requisite personal information when requested, we may not be able to fulfil your order and may not be able to contact you to give you information about the event or to advise you of any changes to the event including cancellation.
